Declaration of consent under data protection law,
declaration of exemption and transfer of rights of use

 

1. Data protection declaration of consent:

"The Futures Project" or The Futures Project guG collects, processes and uses the personal data you submit in the course of your submission exclusively in connection with the implementation, screening and publishing of the initiative "Call to Action for Innovators for the Future".

All personal data, photographs, other images or films provided by you to us for the project may be published in all media forms, online or offline, for the purpose of communication around the Call for Innovators initiative.

As a participant, you agree that you and your company or your institution will be mentioned and your idea and your initiative will be named and presented in public, especially in the press, by the press and public relations work of the initiative "Call for Innovators for Innovators for the Future”.

Please refer to Annexes I and II for more detailed information on data privacy and image rights.

2. Dedicated disclosure of your data and confidentiality obligation

We will forward the data you provide to our partners strictly for the purpose of supporting the project as well as press and public relations work of the "Call for Innovators" initiative. The project partners have been bound by us to data secrecy, and the project partners, as well as ourselves, are not permitted to use personal data for purposes other than the support and implementation of the initiative without your further separate consent.

3. Exemption declaration:

In the event that legal action is or will be taken against you or a representative of your idea/your project in connection with the idea or innovation submitted to the initiative or that proceedings are or will be pending, in particular if the legal ownership of the idea is legally challenged by third parties, we reserve the right to exclude you from participation and subsequent publications at any time. We also reserve the right to exclude you from participation and subsequent publications at any time if it becomes clear that you or a representative of your project does not feel committed to free democratic values and/or lacks respect and tolerance for your fellow human beings to such an extent, or if you or a representative of your project otherwise behave in such a way that the initiative "Call for Innovators" and/or subsequent events are at risk of suffering damage.

4. Transfer of rights of use:

Furthermore, you transfer to the initiative "The Futures Project" or The Futures Project gUG for your institution/association/project the rights of use, unlimited in terms of time, space and media, to all photographs or other images and films provided by you for the project, so that "The Futures Project“ can use them for communication about the initiative "Innovators for the Future" in all media forms, online or offline. You confirm that the persons depicted in the photographs or images have given their consent to such use.

Your consent can be revoked at any time with effect for the future, in whole or in part. In case of a revocation we will immediately remove the photos and the name from our website. If we have also used material from you in other media such as videos or print products, we will continue to use this material. Should there be a new edition of these media, we will of course then use material that does not show you and remove your name from it.

You have the right to request information from us about the data we have stored about you. Please send all requests for information, requests for disclosure or objections to data processing by e-mail to call@futures- project.org.

5. Additional Provisions

Participation in this Call does not constitute any guarantee of selection. The application and selection process is entirely at the discretion of The Futures Projection. The Futures Project may determine in its sole discretion to close this competition without making any award(s) at any time. The Futures Project reserves the right to stop all activity for the Call and/or to make substantive changes to the Call and selection procedure, which might preclude certain users from participating further.

 

ANNEX I

 

Data protection information for the Global Open Call to Action for Innovators for the Future

The participation and processing of personal data is required to participate in the Global Call to Action for Innovators for the Future. In the following, The Futures Project informs about the collection of personal data in the course of registration and its further processing in the context of the project. Personal data are all data that are personally related to the participant, e.g. name, address, date of birth or email address.

§2 Collection and use of your data

To carry out the project, we ask you for your name, your e-mail address and your location. We need this data in order to be able to carry out the project, in particular to check your eligibility and to inform you in the event of a nomination. The legal basis is Art. 6 Para. 1 S. 1 lit. b) GDPR.

We will only use the above data for advertising purposes if you have given your consent. The legal basis is also Art. 6 para. 1 sentence 1 lit. a) GDPR.

The information provided by you can also be passed on to companies affiliated with us or processors based in Germany, who process data for us as a service provider (e.g. agencies for the implementation of the project).

 

§3 Deletion of your data

We delete or anonymize your personal data as soon as it is no longer required for the purposes for which we collected or used it in accordance with the preceding paragraphs. We generally delete the data of participants who are no longer engaged with the project within 90 days of the end of the project, i.e. after the Munich flagship conference on 7 and 8 December 2020.

 

§4 Automated individual decisions or measures for profiling

We do not use automated processing to make a decision - including profiling.

 

§5 Your rights as a data subject

As a person affected by the processing of personal data, you have a right to information about the processed data, a right to have your personal data corrected, a right to have your personal data deleted, a right to restrict the processing of your personal data and a right to the portability of your personal data. You also have the right to lodge a complaint with a supervisory authority.

In addition, in cases where data processing is based on Art. 6 Para. 1 lit. e or lit. f GDPR, or for the purpose of direct advertising, the right to object to processing.

 

§6 Transfer to third countries

The transfer of personal data to non-EU / EEA countries (the so-called third country) does not take place.

 

ANNEX II

 

Granting of image and video related rights

I hereby grant TFP (THE FUTURES PROJECT gUG (haftungsbeschränkt) (in short: TFP), Chausseestr. 36, D-10115 Berlin), free of charge, the unlimited right in terms of time, place, and content to use, reproduce and distribute the images and video material I have taken and submitted on the occasion of the project Global Call to Action for Innovators for the Future and on the Internet or social media channels such as Twitter, Instagram or Facebook and use it in reporting and advertising evaluation of the campaign and in all media, including print media, poster advertising, PR measures and the Internet. I understand that the publication is at the discretion of TFP.

Consent under data protection law

I also agree that TFP will publish the images and videos I have taken and submitted on the occasion of the project Global Call to Action for Innovators for the Future on the Internet on social media channels and use them in the reporting and advertising of the campaign, and in all media, including print media, poster advertising, PR measures and the Internet. There is no naming of the creator. I can revoke my consent at any time with effect for the future by emailing call@futures-project.org.

Data protection information:

  1. The processing of my data for the above-mentioned purposes takes place on the basis of your consent (Art. 6 (1) (a) GDPR). The information is voluntary. The Futures Project deletes or anonymizes my personal data as soon as it is no longer required for the purpose for which TFP collected it in accordance with the data protection law consent above, or as soon as I revoke your consent.
  2. My personal data may be passed on to agencies for the purpose of processing the image and / or film material or to printers or to media partners for the purpose of publication in the media mentioned above. There is no transfer of data to regions outside the EU / EEA.
  3. As a person affected by the processing of personal data, I have a right to information about the processed data, a right to correction of my personal data, a right to deletion of my personal data, a right to restrict the processing of my personal data and a right to transferability of my personal data. I also have the right to lodge a complaint with a supervisory authority.

Internet disclaimer

I am aware that information on the Internet is accessible worldwide, can be found via search engines and can be linked to other information that can lead to the creation of personality profiles about me (e.g. Clearview). I am aware that information published on the Internet, including photos, can be easily copied and distributed. I am also aware that there are special archiving services (e.g. waybackmachine on archive.org) that permanently document the condition of certain websites. For this reason, information published on the Internet can still be found after deletion.

Social media disclaimer

With regards to social media publications, I am aware of the following:

Social networks “multiply” content without TFP having any influence on the number of distributions. By commenting and then sharing TFP’s original publication, there is theoretically the possibility that the people depicted will be unfavorably commented on.

When publishing in certain social media offers (e.g. Facebook), it cannot be ruled out that a complete deletion of the photos is not possible. I have taken note that the deletion of the images from the TFP company website can take up to three working days after receiving my cancellation.

Print publications

With print media, my revocation means that TFP will no longer publish my photo in new editions of the products that have already been printed.

Summary: I agree that my images and videos will be published in the media mentioned above. My consent is valid from the date of signing in and registering.
